Hotsauce Terms of Service

1. Eligibility and parental consent

The Service is for high school athletes who are at least 13 years old, their parents or legal guardians, and coaches. It is not for children under 13. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on the minor's behalf and is responsible for the minor's use. By allowing a minor to use the Service, a parent or guardian agrees to these Terms and consents to the collection, display, and sharing of the minor's profile content as described here and in the Privacy Policy.

2. Your account

Creating an account requires checking the box agreeing to these Terms. By checking that box and completing signup, you electronically accept these Terms and confirm you have the authority to do so, including, for a minor, the parent or guardian's consent described in Section 1. You cannot create an account without agreeing.

You agree to provide accurate information, keep your password secure, and remain responsible for activity under your account. Notify us promptly of any unauthorized use. You may not create an account for another person without their permission, and for a minor, without the guardian's permission.

3. Your content

"Your Content" means the profiles, video clips, images, text, and other material you submit to the Service.

You keep ownership. You retain the rights you hold in Your Content.

License to us. You grant Hotsauce a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (for example, to assemble clips into a continuous reel and to resize media), display, and distribute Your Content as needed to operate and provide the Service, including displaying it to people you share a profile with. This license ends when you delete Your Content or your account, except for content already shared with others and copies retained for backups or to meet legal obligations.

Your representations. You represent that you own or have the necessary rights to Your Content, that it does not infringe anyone's rights, and that you have the consent of every identifiable person shown in it. For a minor's profile or media, the parent or guardian represents that they consent to the minor being depicted and to the content being shared as described in these Terms and the Privacy Policy.

4. Acceptable use

You agree not to:

• Upload content you do not have the right to share, or that infringes intellectual property, privacy, publicity, or other rights;
• Impersonate any person or misrepresent an affiliation;
• Upload unlawful, harassing, hateful, sexually explicit, or otherwise objectionable content;
• Post another person's private or contact information without permission;
• Use the Service to harm, exploit, or endanger a minor;
• Attempt to gain unauthorized access to the Service or interfere with its operation or security;
• Scrape, harvest, or collect data from the Service except as expressly permitted;
• Use the Service for any unlawful purpose.

We may remove content, or suspend or terminate accounts, that violate these Terms.

5. Sharing and third parties

Profiles are shared by a private link that you control. You understand that anyone who has a link can view the shared content, that links can be forwarded, and that you are responsible for whom you share a link with.

Hotsauce does not verify the identity, credentials, or intentions of coaches or other people who view or respond to a profile, and does not endorse any user. Any communication or relationship between users, including between families and coaches, is solely between those parties and at their own risk. Hotsauce is not a party to and is not responsible for recruiting decisions, outcomes, or any interaction that takes place on or off the Service.

6. No guarantees

The Service helps you present and share a profile. We do not promise any particular result, including that a coach will view a profile, respond, or recruit a player, or that any level of exposure or interest will result.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOTSAUCE AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow certain of these limitations, so some may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Hotsauce and its owners, employees, and suppliers from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination, including content licenses already granted to others, disclaimers, limitation of liability, and indemnification, will survive.

11. Changes to the Service and these Terms

We may change or discontinue the Service, in whole or in part, at any time. We may also update these Terms. If we make material changes, we will provide notice, such as posting updated Terms with a new date. Continued use after changes take effect means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
